This Release and Waiver of Liability (the “Release”) is executed by legal guardian (the “Parent”) in favor of Frankfort Area Swim Team, Inc. (FAST), a nonprofit corporation, and its directors and officers. The Parent desires to have FAST engage in the activities related to teaching swimming concepts to a minor who is under legal guardianship of the Parent . The Parent understands that the activities may include swimming, dry land and pool related activities, jumping and entering the pool from a 1 meter diving board, and other activities related to learning the life skill of swimming. The Parent does hereby freely, voluntarily and without duress execute this Release under the following terms:
WAIVER AND RELEASE.
Parent does hereby release and forever discharge and hold harmless FAST and its successors and assigns from any and all liability, claims and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from activities associated with FAST. Parent understands and acknowledges that this Release discharges FAST from any liability or claim that the Parent or Guardian may have against FAST with respect to any bodily injury, personal injury, illness, death or property damage that may result from minor participation in swim activities with FAST, whether caused by the negligence of FAST or its officers, directors, or agents or otherwise. Parent also understands that, except as otherwise agreed to by FAST in writing, FAST does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury or illness.
MEDICAL TREATMENT.
Except as otherwise agreed to by FAST in writing, Parent does hereby release and forever discharge FAST from any claim whatsoever that arises or may hereafter arise on account of any first aid, treatment or service rendered in connection with the swim activities associated with FAST.
ASSUMPTION OF THE RISK.
The Parent understands that the swim activities with FAST may include activities that may be hazardous to the minor, including, but not limited to, activities may include swimming, dry land and pool related activities, jumping and entering the pool from a 1 meter diving board, and other activities related to learning the life skill of swimming. . In connection thereto, Parent recognizes and understands that activities at FAST may, in some situations, involve inherently dangerous activities. The Parent hereby expressly and specifically assumes the risk of injury or harm in these activities and releases FAST from all liability for injury, illness, death or property damage resulting from the swim activities with FAST.
INSURANCE.
The Parent understands that, except as otherwise agreed to by FAST in writing, FAST does not carry or maintain health, medical, or disability insurance coverage for any minor participating in swim activities. Each Parent is expected and encouraged to obtain his or her own medical or health insurance coverage.
PHOTOGRAPHIC RELEASE.
Parent does hereby grant and convey unto FAST all right, title and interest in any and all photographic images and video or audio recordings made by FAST during the swim activities with FAST, including, but not limited to, any royalties, proceeds or other benefits derived from such photographs or recordings.
OTHER.
Parent expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Kentucky, and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Kentucky. Volunteer agrees that in the event that any clause or provision of the Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
